The Orphan's Court shall decide on the entry of the surname, name or nationality of the child, if the parents cannot agree on it.
The Orphan's Court shall settle:
1. disagreements between parents in matters of the custody of the child (except disagreements regarding the determination of the place of residence of the child) and, if necessary, take a decision,
2.. disagreements between the child and the parents;
3. disagreements between the child and the guardian, as well as between the guardian and the parent of the child;
4. a dispute between the person under the auspices and his or her trustee.

Process description

  1. Service requests
    The Orphan's Court shall decide on the entry of the surname, name or nationality of the child, if the parents cannot agree on it.
    The Orphan's Court shall settle:
    1. disagreements between parents in matters of the custody of the child (except disagreements regarding the determination of the place of residence of the child) and, if necessary, take a decision,
    2.. disagreements between the child and the parents;
    3. disagreements between the child and the guardian, as well as between the guardian and the parent of the child;
    4. a dispute between the person under the auspices and his or her trustee.
    The person must produce a personal identification document.
    Required documents:
    1) an application with the requested request and the justification of the request;
    2) copies of the information supporting documents necessary for the examination of the case and indicated in the submission (presenting the original) at the discretion of the submitter.

    The Orphan's Court shall ascertain whether there are disagreements between the participating parties, whether the parties cannot agree and the taking of a decision is the only way to resolve the situation.
    Information and the circumstances of the situation shall be identified in each particular case.
    The dispute shall be settled, taking into account the interests of the child or the person under the auspices and clarifying their views, provided they are able to formulate them.
    Documents may be entered in person, transmitted electronically (with a secure electronic signature) or by post.

  2. Receipt of services
    The decision shall be taken at the meeting of the Orphan's Court and shall be notified to the parties.
    The Orphan's Court shall draw up the decision in writing and send the transcript thereof to the participant in the administrative process within 10 working days after the taking of the decision. A true copy of the decision can also be received in person at the Riga Orphan's Court.
    Similarly, a decision/reply can be sent to a person by post, to an e-mail address or to the electronically agreed portal for national and municipal services in www.latvija.gov.lv.
