Get a service

The Law determines the procedures for the alienation of the property of a public person. The property of a public person who has been transferred to the possession or possession of an institution or capital company shall also be alienated in accordance with the procedures specified by law. The Law shall not apply to:
1) the alienation of property rights owned by a public person (securities, capital shares in capital companies, etc.), the procedures for the alienation of which are determined by other laws;
2) State and local government property which is privatised in conformity with the laws On Privatisation of State and Local Government Property Objects, On Privatisation of State and Local Government Residential Houses and Land Reform Laws.

Process description

  1. Service requests
    The purpose of the service is to ensure the process of disposal of rented apartments (their presumed parts). As a result of the sale of the local government's real estate, property rights from the municipality of Riga are transferred to the acquirer of the property. Following the initiation of the alienation of the relevant apartment property (the alleged part thereof), the privatisation commission of Riga municipality residential houses shall prepare a draft decision of the Riga City Council regarding the object to be alienated
    the transfer for disposal and upon receipt of the notification of the person regarding the use of the right to pre-emption of the object, a decision shall be taken regarding the conclusion of the purchase contract/payment purchase contract. Where a proposal for alienation is submitted by a tenant or a member of his or her family, the following documents
    1. a statement regarding the existence/absence of an indication of the existence/absence of a rent and a statement that an action has not been brought before a court for the termination of a rental contract and the eviction of a tenant and his or her family members (original);
    2. the rental contract for residential spaces and Annex 1 thereto on the right to use residential spaces (registered in the Housing and Environment Department of the Riga City Council) (original or certified copies);
    3. Annex 3 to the rental contract for residential spaces - a document on the basis of which a rental contract has been entered into (certified copy);
    4. a notarised agreement between the tenant of the apartment concerned and the members of his or her family regarding who or who will acquire the residential house or apartment property (original);
    5. a copy of the personal identification document of the initiator of alienation;
    6. if the documents are submitted by the authorised representative, a copy of the authorisation document must be submitted, presenting the original and the identity document thereof;
    If a proposal for alienation is submitted by an apartment owner who has the right of pre-emption to another apartment in the same multi-apartment house, the following documents shall be attached:
    1. a mutual agreement between the owners of apartment properties in a multi-apartment house in which the right of pre-emption has been established (certified copy);
    2. a copy of the identity document of the initiator of the alienation;
    3. if the documents are submitted by the authorised representative, a copy of the authorisation document must be submitted, presenting the original and the identity document thereof;
    4. the legal person must submit the articles of association (a copy showing the original);
    If a proposal for alienation is submitted by a joint owner who wishes to terminate the joint ownership relationship with the local government, the following documents shall be added:
    1. a copy of the personal identification document of the initiator of alienation;
    2. if the documents are submitted by the authorised representative, a copy of the authorisation document must be submitted, presenting the original and the identity document thereof;
    3. The legal person must submit the articles of association (a copy showing the original).

  2. A service charge
    The payment of the service is determined by the Law on the alienation of the property of a public person.
    The sale price of an apartment property shall be composed of: the notional price, which according to the value of the property shall be determined by the property valuation commission;
    Statutory interest that is paid when the object is purchased for payment.

  3. Receipt of services
    A person receives a service in the presence of the privatisation commission of residential houses of Riga municipality. The service execution documents are sent to the person by mail in a registered letter and are presented with a secure electronic signature.
